All work done by Letters by El is on the understanding that the client has read and accepted the Letters by El terms and conditions. It is the responsibility of the client to check them before entering into a contract with Letters by El. All designs belong and are copyright to Letters by El. They are not to be reproduced by yourself or any other party.
Letters by El reserves the right to use any of the stationary designed and created for you to promote business and services. However, I will never share personal information.
Every design is copyright and property of Letters by El. Reproduction by yourself or any other party may only be done with prior consent from Letters by El. Improper and illegal use of my work will be pursued. If variations of a design are presented to you, only your chosen option is deemed as Letters by El fulfilling the contract. Unless agreed in writing, All other design proofs remain property of Letters by El.
If the client provides Letters by El with their own illustrations, text or images, ownership will remain with the client or the rightful trademark/copyright owner.
Proofs from Letters by El will all be sent via email unless otherwise requested. Letters by El take great time and care making sure all information on your commission is accurate. However, it is your responsibility as the client to proof read (i.e. check the grammar, spelling and layout) before instructing Letters by El to finalise the design for printing. Letters by El will ask the client to send the wording that you want included in your design and will presume all information that has been sent is correct. The client must ensure the final design proof is correct before giving instruction to finalise the commission.
Letters by El will not take any responsibility for typing/layout errors that have been signed off by the client. The client will be liable for any additional costs to fix the error. It is advised that you and someone else checks all design work thoroughly before communicating that it’s ready to be finalised.
Note that colours you see on your screen will differ from the printed results. This is due to light and pigment being different on a screen and paper. It is advised to order a printed sample of the commission to ensure you are happy with the colour.
A number of design and proofing has been included in the pricing of the commission to make sure the client is satisfied with the commission. Three proofs before the final one are included in the initial pricing of the commission. However, until you are happy with your design, changes can still be made. Additional proofs after 3 changes will be additional costs (see additional cost section for more details). Letters by El will not be held responsible for delays if proofs are above 3. Be aware that this may subsequently delay printing and shipping.
Quotes and Payments
Commissions and bespoke designs will be quoted individually. Included in the quote document will be a deposit amount of 50%. Full payments are due for quotes £100 and under. Work will commence once the first payment is received by Letters by El.
For printed items: when the final proof has been approved by the client and instruction to print has been given, the final invoice with the outstanding amount will be sent to you by email. Once the client has paid the final amount, Letters by El will proceed to print/complete your order. As a result of a late payment, Letters by El is not responsible for delays in printing and delivery.
For on-site commissions: If the total cost is over £100, the final payment is due 14 days after the work is completed. If there are additional costs to pay, these will be added to the final invoice and be sent to you by email.
Additional costs will be discussed before being added to the invoice.
Invoices that are not paid by 14 days after the date of invoice will be charged an additional 2% (as interest) which will rise each month payment is not received. Additional charges will also apply after 3 proofs have been emailed. Cost start from £50 but will vary depending on the extra work entailed. Letters by El will let the client know about the additional charges by email before completing the change and adding the amount to the invoice.
On-site/ commercial Commissions
For commissions such as chalkboards, window/ wall murals, surfaces must be cleaned and prepped by the client. A 50% charge will be added to the invoice if the client has not done this before Letters by El arrives on site to start the job. "@lettersbyel" will be included on all art work carried out on chalk boards, windows and walls.
Additional terms for Digital commissions
All digital commissions have an automatic design licence release for 1 year. Additional costs apply for 3 and 5 year design licencing. Letters by El will supply digital files for commissions once final payment has been made.
My process from sending proofs - making adjustments can take up to 2-4 weeks. This depends on the changes requested by the client. However, please note that this time frame is just a guideline and Letters by El will not be responsible for delays in the process if the client requests additional changes after this period. Letters by El will finalise the process as soon as payment has been received and confirmed. However, on the rare occasion, please note that the finalising process can take up to 6-9 weeks so ensure that you leave enough time putting in your commission request before your completion date. Rush fees can be applied if requested.
To cancel an order, Letters by El must receive a request in writing via email. Letters by El will then invoice the client for work already undertaken in addition to the non-refundable deposit.
Refunds and Reprints
Once an order has been completed, it is not possible for Letters by El to refund an order. If the commission has been completed incorrectly to the specification or not completed to a sellable quality, Letters by El can offer a redo free of charge. Reports of this happening must be made within 4 days of your order being received with the issues being put in writing via email to Letters by El clearly.
As soon as the commission has been dispatched from Letters by El, the responsibility becomes the delivery providers. Letters by El is not responsible for lost or damaged items once your order has been dispatched. Letters by El is responsible for commercial commissions while onsite. Once Letters by el is not onsite, this is the client's responsibility. Letters by El can be contacted for a quote to touch up/ redo part or all of the commission needed due to wear and tear.
